speeding N.O.I.P

I was pulled over by a unmarked police car on the 3rd november for speeding on my motorbike which i was riding on a provisional licence, I recieved a fixed penalty notice. 3 days before i passed my driving test. 4 months before i recieved 3 points wen my L plate fell off. so now im looking at getting my licence revoked. When i had to produce for the second set i didnt have my licence because my examiner sent my provisional off to be made into a full.t est pass certificate which i was told was my licence till it came through. The sargent on the desk didnt have a clue on what to do cause i didnt have my licence so she put it down as i hadnt produced and said i would hear from them through the post and that was on the 9th november 2007 and i didnt hear anything until yesterday the 28th feb where in there letter they asked me too send both parts of my licence to them. does the N.O.I.P still have to be served within 14 days in these circumstances.

A Notice of Intended Prosecution (NIP) only has to be served if you were not warned at the time of the offence that you may be prosecuted.

Your question is a little disjointed and I�m somewhat confused, but if I�ve got it right it seems that you were warned in person for each of these alleged offences (the speeding and the failing to produce). So the question of a NIP does not arise.

Please let me know if I�ve got it wrong.

As for revocation (again correct me if I�m wrong) it seems that all these offences were committed before you passed your test. Revocation only takes place if you incur six or more penalty points for offences committed within two years after you pass your test. Any points you have gained before passing your test count towards this total. So this means that if you commit any offences which attract points before the second anniversary of passing your test your full licence will be revoked.

Nothing's your fault is it? It wasn't your fault that your L plate 'fell of'. It wasn't your fault that the sergeant discovered you didn't have a licence.

No doubt when you knock someone down and kill them, it won't be your fault. They should have been looking out for a speeding semi-literate motorcyclist that thinks they have a god given right to do as they please.

new judge, i got 1 set of points on my provisional be4 passin my full test and another set 3 days after passin so this equals 6 on my provisional so do they get transfered over to my full licence. MAMJET im not sayin it wasnt my fault i jus wanna see if i can get away wi it! i was licenced on my bike on a provisional with a cbt!! Semi-literate you cheeky good for nothing toe rag!!! Try to ignore people who wind you up, littlevanman. It doesn�t help you with your question. There are number of users of this site who simply cannot resist a dig at anything they consider they wouldn�t get caught doing themselves.

Now, back to your question.

All the six points will be transferred to your full licence. There are two things for you to worry about now:

The rules on revocation state that drivers who incur 6 or more points within two years of passing their test have their full licence revoked and revert to provisional status. Points gained prior to the test count so, unfortunately for you, it means your full licence will be revoked.

The second problem is that the six points remain �active� on your licence for three years from the date of the offences. This means that if you acquire another six before any of the first six are de-activated you will be disqualified from driving entirely for a minimum of six months.

Points only come off when you are disqualified under "totting up" (12 points in three years).

thanx new judge, but does this mean once its revoked i have to wait for the 6 points to expire before taking my test again n do i have to apply for a new provisional or will i go back automaticaly to the status before taking my full test, in other words will i still have my CBT. Is there no law on the time period they can wait before prosecution once they know an offence has been commited because 4 months is a long time to leave it. thanks
