i am a developer and i want to raise finance by the buy to let route. i need to create titles for the mortgage company.. My solicitors says give a deed of gift for nil cost of the land to my son..This way there should be no satmp duty. If i give it to my son can he then in return give the same deed of gift back to be so i own the 100% once again. As the deed of gift is set at zero it will not create stamp duty. Can this be done twice evading stamo duty. The problem is if he goes bankrupt whilst i am trying to sell the apartments i could loose all or some of my security.
