I went thru a solicitor as advised due to amount involved and got a judgement against him but the charge on his propertytwas turned down due to it being :a personal debt ' . His house was sold and then he did a runner ,surprise, !!five years on and I am still trying to find a solution. I found the local county court helpful, but you can try money claim online only not sure if it can be done due to large amount involved. Good luck.
Netta: What you say is very odd - it is certainly possible to get a charge on a house for a personal debt.
Zin: The normal process is to go to Court, get a judgement and then - if the debtor does not satisfy the terms of the judgement - go back to Court to request a charging order.
However, there are things which can be entered on the Land Registry - a Restriction or a Unilateral Declaration - which may help you. Talk to their helpline about this. Either of them has to be notified to the debtor, so you partner is going to find out what you have done.
