as I understand law the fence to the right of your house is yours which by law should be maintained by you however if a fence belongs to the council should they not be governed by the same law or should the responsibility lie with the tennent even though it is on the left side which backes onto my garden Any useful info would help

Hello bayliss , was the fence put there by yourself or by the council ? I would think it the councils responsibilty if the latter applies. However , I also assume it'sup to you as the tennant to inform the council if it's in a state of disrepair :-) x

That's not strictly true, bayliss - ownership of the fence (or any boundary eg a wall) depends on what the title deeds say. In the Q mentioned below, PostDog refers to a very useful site that you might want to have a look at

If the council do own the fence you are referring to, then you need to contact them - if you are not sure, then contact them anyway to find this out.

The responsibility would be with the owner of the land, not the tenant anyway.

That's one convention, not a law - there are others. And deeds (see above) are not always specific - my own make no mention of ownership of fences.

And as to maintained by you - no, in general there is no obligation for an owner to maintain it. You must see that it is not a danger to anyone but beyond that you can do what you want - remove it altogether if you wish
