Is it a criminal offence to employ someone to work with children WITHOUT having done a CRB check, OR is at an offence to employ anybody WITH a criminal record to work with children?

it depends on the company who employs them,they must have done some sort of checks on the person concerned,but if their record is for petty things and not to do with kids,then whats the problem.

It is part of OFSTED requirements that, if the place you work for is OFSTED registered then the employees must have an enhanced CRB check
