placing a charge on my ex's house for maintenance arrears

My ex owes me over �5000 in maintenance arrears from the last 10 years. He has put his house up for sale (this was our house but I walked away from it empty handed). Can I put a charge on his house to get the arrears paid even though the arrears payments are being arranged through the CSA? (Although he still isnt paying it or regular maintenance).

I take it the house and any mortgage is in his sole name or you transferred your part to him so his sols name is on the title so he can sell it without your consent.

Speak to the CSA about any enforcement action they can take and whether a charging order can be obtained which can be registered on the property and has to be paid off before he sells.

The fact he may have some equity coming his way may encourage the CSA to come doen harder on him.

I'd act quick though if he is selling. Speak to the Land Registry about what proof you'd need to put an entry on the register.

The ideal scenario would be to put a restriction on so that he cannot sell without the maintenance being paid off.

Yes the child is his 100%. The child was planned by both of us & much wanted. He was the one that went to the CSA when I asked for �20 a week maintenance & he thought that was unfair!! The proof is on all the letters I still have from 10yrs ago written by him.

Thank you Jenna for your advice. Going to see a solicitor this week, although it will cost me several hundred pounds!
