entitlement to exhusbands pension
2 Answers
My ex-husband is 65 next month. We divorced after 20 years marriage in 1988. He has re-married but I have not. There was no sharing of assets and he only paid 20 towards the up-keep of our daughter who was still in education at that time. Am I entitled to claim part of his works pensions. I have worked since the divorce and am still working part time even though I am 61.

If it wasn't part of the divorce settlement, no.
I was divorced many years ago and at the time my ex-husband's pension was not taken into account in our divorce settlement. Can I apply now for some of his pension?
No, that is not possible; the legislation is not retrospective.

And as he hasn't been maintaining you since the divorce you would have no chance in any case. I assume his earned income was greater than his pension - if you had been entitled to maintenance you would have been receiving it before he retired.
