split with partner part 2
my ex partner does not pay anything towards morgage since left but bank wont take name of so what can i do why should be paying all morgage and he get half and i cant sell and downsize as got two bed and two kids so if someones been in similar situation and got round it i would be greatfull an answer thanks

As it stands at the moment, they have 2 people to chase for money if the mortgage isn't paid, if they remove your ex then they have only one - you.
Have you got a job? Does your ex pay maintenance for the children? Don't wish to be nosy but how much is the mortgage and how much do you earn?

You probably need legal advice. You have to bear in mind the following. Half the house is his and half is yours. You could force him to pay half the mortgage, but in return he could charge you an "occupation rent" for occupying "his half" of the house. Generally the two cancel each other out. So keep on paying the mortgage, and if you can see if you can remortgage to buy him out.
