Is it illegal to advertise a job which the employer has no intention of interviewing for?

Could someone please clarify for me. If an employer has a vacancy, but they already have someone they are going to give the job to, I know that they sometimes place a very samll advert in a paper (any paper - ie - not local!) so that they get very few enquiries. Is this legal?
Also, if they DO receive enquiries from extremely qualified people, who are certainly able to fill the requirements, do they have a legal requirement to interview?
My husband applied, and was told that they were were interested and would follow up the following week. they didn't. Now, whenever he calls (and he has also emailed to ask for an update), he is told "she's not in", or "she's stuck in traffic", or "she's upstairs"(!?)

Maybe your husband wasn't suitable for the position and that's why he hasn't been selected for interview?
It is certainly legal to advertise with a minute advert in some obscure newspaper, in fact the employer is under no legal obligation to advertise the position at all, they could just give it to whoever they wanted with no interview or anything.
I'm pretty certain they have no legal obligation to interview once applications have been received either.
