I started working for my last employer in October 2007 and signed a contract of employment which after giving back to the employer, I never have seen since. In January I passed my 3 month trial period with my employer and all seemed to be going well. On returning back from a holiday last month I opened a letter dated 16th July at home from my employer stating that my employment had been terminated. (Had been there under one year I know). There was no particular reason for the termination given in the letter, only that not enough improvement had been made after a meeting I had in May (this wasn't a disciplinary meeting).
On the 31st July I had not received my wages which we were always given as a cheque so I waited afew days to receive this in the post. When it hadn't arrived within 7 or 8 days I emailed my former employer asking for my settlement cheque (which they'd promised to send on in the termination letter) and P45 which they assured would be sent within 2 days. However, this is almost a week ago and nothing has arrived. I emailed them yesterday but to no reply and now am getting worried that they won't be sending anything.
Can anyone help on where I would stand legally with this?
You are entitled to the wages up to 16th, plus money for notice period from the date of 16th July - possibly 4 weeks notice, dependent on your contract.
