The offence is �either way� meaning it can be heard either in the Crown Court or at the magistrates� court.

Nonetheless it is a serious offence (maximum penalty at the Crown Court is 5 years � or 7 years if racially aggravated) and the magistrates would normally only retain jurisdiction if the assault was unpremeditated and no weapon was used.
