mortgage split 3 ways

if 3 people purchased a house between them and only 2 of them spent any money on the maintenance/upkeep/general repairs etc. over the 25 years . As an when the house was sold could they make a deduction from the 3rd persons profit of the sale?
Unfortunately they were given bad advice at the begining and no agreements/contracts were put in place to cover anything like this .

i think if the 3rd person wanted to contest it, you would have to prove it, and i can't really see how you could prove a negative.
How much money are we talking about? are you talking about building work, or structural stuff? or just cushions and blinds etc?

looking at decorating , general -up keep, new toilet, shower ,conservatory, electrics,plumbing...
basically all the 3rd person has done is pay there 3rd of the mortgage and has not contributed a penny to anything else..
the mortgage is nearly finished and they are considering selling ,the other 2 people involved are annoyed that in terms of cash they have invested far more in the property and would like to try and at least get some of it back

Have you spoke to the 3rd party about it. If they do not agree then you will need proof. It's 2 against 1.....

If you are stupid enough to go on maintaining the property for 25 YEARS,and not getting any monies for it from the 3rd party then I think you deserve all you get!

I would check with my solictor on this one. It might cost but if you can prove all you maintain then there may a case for differential payments. Lets hope everyone can come to an amicable arrangement over such a contentious issue

It all depends on what the original agreement was. if all three agreed to pay a third of everything, you do have a claim for equitable accounting against the third. I would seek legal advice.

thats the problem no agreements in place, they really didnt get any legal advice at the beginning seeing as a solicitor sorted the mortgage it seems odd.

To be honest i think its going to be more hassle than its worth..Its just annoying someone who has invested approx �12,000 and ended up no more than a lodger stands to gain �80,000
