passing a van blocking a junction could be an offence such driving without due care aldo it is save to do so

at a small junction a van turning right was blocking my side of the traffic, after waited for more then 30-40minutes, i carefully assessed the situation and observed the first car of the incoming car awaiting to turn right , when the light get green i wait couple sec to be sure then only then i moved into the other side of the road without causing any trouble at all slowly in controle . then a police patrol come to the right and ask me to go back. i told then why i did thaat.they told me i will prosecuted for driving without due care and attention. now i 'am sommonsed to a court for that offence and the police a putting more weight by saying there a bus blocking my view i wish is not true, i'am very angry about that twist.
any advices.

Was the van waiting to turn in the same direction as you?

If there was something blocking your view I'm not sure how else you are supposed to pass it other than slowly and carefully which you seem to be describing is what you did
