Redundancy

I have been off sick for a number of years but am still on the companys payroll - am I entitled to redundancy pay?

I was in a similar position and was informed that while you are sick you can't be made redundant.

I negotiated a deal with the company in the end but I'm not sure if all companies would do that and also as I decided to give up work entirely didn't have to worry about benefits etc.

Nannyjill</>, you CAN be made redundant whilst off sick. Otherwise as soon as there was a whiff of redundancies in the air, everyone would go off sick in order to avoid being chosen!

Sickness does not bar you from redundancy. As you are still on the payroll your service will be calculated as if you had been at work even if you haven't been getting paid.

Correct. Indeed sickness/absence record may be one of the key criteria used for selection for redundancy. All perfectly fair in the eyes of the employment legislation.

I assume that although you are on the payroll you are no longer getting paid.
Redundancy pay is to cover lost future earnings, so to claim severance pay I wonder if you may have to argue you that you would have been able to return to work in the near future.
