do my undeclared licence points invalidate my insurance after my accident?

hi, i had an accident 3 weeks ago,(my fault) wrote off mine and another car, phoned up insurance company today to notify them of 3 points i've just had on my licence, to find out they never received my letter when i origionally set up insurance last year which detailed 3 points from march 08, does this invalidate my insurance or do they need to prove i didn't send the letter? many thanks, wendy

They should pay out to cover replacing the other driver's car (and for any legitimate injuries compensation claim from the other driver). However, they'll almost certainly refuse to pay out in respect of your vehicle, even if you've got 'fully comp' insurance.

Yes, Wendy, your insurers must pay out to the other driver but, as Ethel states, they may then seek to reclaim the money from you. (Theoretically they could also report you to the police for possible prosecution under the provisions of the Fraud Act 2006, but I think that's probably unlikely).

On the other hand 3 points isnt the end of the world as long as that is all it is and assuming it was not for Construction and Use)and they probably wouldnt have underwritten much against you. I have dealt with a couple of similar cases where the insurer accepted the additional premium that they would have charged had they known about the conviction and then agreed to deal with the claim ignoriing the non disclosure.

hi i was haing a car incident(not my fault) and i was insured but i didn t know that i was having a 6penalty points and when ceme to a claim they was having with me and dvla a phone conference and they say that i didn t tell about my points so im worried becouse my claim is suspendet and they have to decide will they accept my case i did propose to pay the diference in price becouse if you have points your incurance is more expensive so what is worst scenario?? any one can help with an anwser will i loose my license?? it is just my honest mystake if i knew about them points i wud tell about them ??
