piece of neighbours mortar/cement falls on and damages my car. I get an estimate for 500 they not happy with and say that their house insurers say it is An Act of God and I have to claim on my car insurance. Can anyone clarify this as it doesn t sound quite as i understood it. Thanks
A piece of mortar falling from a house is not an act of God,it is down to them not keeping up with maintenance on their house. Ask them to show you the letter from their insurers stating that they are not obligated to pay as it sounds to me like they might be lying.
Ive always assumed if a roof tile fell off my house and killed someone my insurers would cover it. I must check!
Even if your neighbour is not covered I think he is lstill liable. Generally insurers can deny responsibility if the insured knew about the fault and did notr epair it. You could claim from your insurers and let them argue the toss.
