Is 54 mph in a 30 mph zone considered excessive and worthy of going to Magistrates or will this be a fixed fine??

Thanks

Usually there is a leeway of 5mph. If you're over it, you will be charged. i would accept the fixed penalty, unless there were no clear road signs saying it was a 30mph zone.
The usual limit for a FP in a 30mph zone is 49mph. You should expect a summons.
The sentencing guidelines state that 54mph, in a 30 mph zone, is not eligible for a fixed penalty. The matter should be referred to the magistrates court, where it would normally be dealt with by the imposition of 6 penalty points and a fine (of roughly 1 times your net weekly take home pay). A ban of between 7 and 56 days is also possible:

If I am disqualified for 7 - 56 days, does that mean I would have to resit my driving test??
no resit necessary, you'll probably get 4-5 points and a fine of 100-150. Ban unlikely (unless you have a load of othe points but that would be a totting ban). Bit over for a fixed pen but fairly Minor in the scheme of things.
If you passed your driving test less than two years before the offence and if you are awarded six points (or if any points you are awarded brings your total to six or more) your full licence will be revoked and you will have to take your test again (both parts).

If you are disqualified for this offence you will not have your licence revoked.
If you were driving at 54 miles an hour in a 30 mile limit, then you are a danger to yourself and others.
"Is 54 mph in a 30 mph zone considered excessive".

Ha ha! That's the best one I've heard today!

Am I likely to get more than 6 points for this offence. I have had my licence this time around for less than 2 years. (After having to resit it after 2 year ban for Dangerous Driving.)
The licence "probation" period only applies following the passing of your first driving test.

In any case, you cannot be awarded more than six points for speeding.
For all the do goody none speeders

I ride a scooter and this morning I was doing 40 in a 30 and cars were overtaking me like I was at a standstill

I have been caught doing 82 in 60 and 93 on the motorway and got 3 points and 60 for both of them
Don't see any of those Jimmy, certainly not me, all I see above is people answering the question, I cannot see one opinion given about the offence.
Shutzengel Geezer

Tell me Jimmy what do you think would happen to you on your scooter if you were hit by Jedimistress doing 54?
I would be in a mess on the floor

My point being that evey day on my commute I see loads of people doing 55 in a 30 where there are no cameras
It sounds like Jedimistress has trouble following the rules of the road..........a 2-year ban for Dangerous Driving.........

Jedimistress, why don't you just heed the laws, rules and regulations of driving ?

I, for one, would feel safer if you would.........
Monkey read my posts

I reckon at least 50% of drivers exceed 30 and dont say you havent at one point or another cos I wont believe you...
I have been driving for 28 years. I have never received so much as a parking ticket.

I drive in strict accordance with the rules of any given stretch of tarmac over which I may be travelling.

In 28 years, I may have flouted the rules very occasionally but I have certainly never been disqualified nor caused/been in an accident.

The price of my insurance premiums is too much concern to me, as is the welfare of my passengers and the safety of other road-users.

If that makes me sound pious, I make no apology. Driving a motor vehicle is a responsibilty, not a right !
Monkey eyes, everybody makes mistakes - yourself included. This is an advice forum and as such it is not anyone's job to pass judgement or make sanctimonious comments after the event.
Jedimistress - unfortunately within the confines of the law, 54mph is considered excessive and therefore automatically gets referred to the magistrates court.
The typical penalty would be:
Points: 6
Normal fine range: £75 - £750
Disqualification possible? Consider 7-56 days
Maximum fine: £1000
I hope this has been helpful - good luck
