Disclosure Scotland application forms
1 Answers
I have a convictiion on my enhanced disclosure dating from March 1962, I was born in October 1947 so I was 14 years 5 months old. I spoke to a woman at the council and she says she cannot understand why this is on my disclosure form, it is for lewd and libidioous practices, (I was caught stealing and wearing ladies clothing) The lady at the council claims that offences committed whilst under the age of 16 should not be included, could anybody advise me whether this is true in Scotland. I also have an item from 1971 but I do not recognise it and wondered how I can get this checked out as it was in Wales?

For more on marking an answer as the "Best Answer", please visit our FAQ.A conviction for lewd and lib is held on the Scottish Criminal History System under their weeding policy of 30 / 70 which means at least 30 years and you must be over the age of 70. This can be extended if you carry out similar offences. Then the weeding will not occur until the new offences are weeded. For sexual offences it does not matter what age you were at the time of the offence.
If you want to dispute an offence you should contact the Force in the area where the conviction occured. There are required to investigate the dispute under the Data Protection Act 1998.
