I do not believe so.
No, you don't pay for services when you don't use them.

so if they are not open on a bank holiday they shouldnt charge.
No, they should not (at least, not in my view).

However, this does not mean that they will not (or at least try to). It may be in their terms and conditions that they are entitled to charge in such circumstances (their argument probably being that they still have to pay their staff, even though they are closed).

You need to look at their terms.
My nursery use to charge.

thats what they say .that they can charge.i just didnt think it was allowed ,but obviously there is no law to say you cant charge..
So, do you have a day off paid for BH's?
Why should the staff of the nursery also not have a day paid?
You knew the rules when you signed the contract
Many nursery's/childcare facilities include in their contract that BH is paid for whether the placement is open or not
Things do not become free just because it is a bank holiday.
PS Do i think its justifiable? Yes i do

Exactly! I catch a bus everyday but I don't pay the driver when I don't use it.

I catch a bus everyday but I don't pay the driver when I don't use it.

Well actually you do. Where do you think wages come from?

op:
I do not see this as a problem then if you have no contract - just dont use the facility., simple!
Why whinge and gripe and wonder if they are acting 'illegally' about something you are not going to do, I don't get it???
Jeeze I missed this bit
',i get help with nursery fees from child tax credit so its not me thats fullypaying out anyway. ' I suppose that makes it ok then, doesn't it?
so again why whine and gripe when you dont even pay for the whole amount??
Think of like this, for that BH you have to pay for its your CTC thats paying, not you
