I was wondering if anyone could give me an idea what someone will get who is charged with abh section47...its my now ex partner beat me up, i didnt have broken bones but he blacked my eye and i had a lot of bruising and swelling. He has past convictions for assault (fighting with people whilst out) and i believe he has been done for domestic violence with a past partner (which I did not find out until now when I have pressed charges for him beating me up this time around)

The maximum sentence for ABH is 5 years, and this offence can be dealt with in the Magistrates Court. In reality, defendants will rarely receive sentences anywhere near 5 years for this offence unless the attack, and defendants with no previous convictions will often not receive prison sentences.

You don't deserve to be beaten up, he seems to be a violent man, so don't back down. Good luck.

hi thanks for getting back to me...so is it likely that he will do time in prison or more likely that he will perhaps get a fine? I am happy enough mind that he has been charged and shown for what he is but I don't think there is enough justice these days agaginst people like him, for the mental abuse he has gave me and the violence, he a danger to the public and any other girlfriend he gets he should be punished....I have learnt my lesson this time, thanks i will stay strong and never go back xx
