Hi, are there any Legal Eagles out there who can help me.???

My partner is waiting for his Divorce papers to be delivered to him, his ex has filed the claim, however he will not be available on the date that he is expecting them..

Can a family member sign for them or does it have to be himself.??

I'm not "legal eagle" but in Scotland under the Simplified Procedure the form can just be passed between the two parties signed and sent to court with an affidavit.

When the conditions for a divorce under the Simplified Procedure are not met the summons can be sent by post or, depending on whether or not it's the Court of Session or Sheriffs' Court, delivered in person by the messengers-at-arms or sheriff officers.

If the messengers-at-arms or sheriff officers consider that reasonable grounds are established for believing that the Defender resides at the address on the summons, papers may be left with someone else living there.
