We have had a debt secured by the court, so if they sell their house we wil get our money owed, but the court has enabled them to repay the debt at �40 a month. They claim they have no money even though they live in a �1m home, numerous cars & vans & massive motorhome. Husband is involved in several businesses. How can we investigate their worth, income etc they are on a 2 week holiday at the moment, it makes me sick, whilst we can't afford one.

Hi, Usual disclaimers as I am not a solicitor so my advice may count for nothing. However, I am on the verge of a similar situation so I have researched it to some extent. You can apply to the court to have the judgement debtor attend the court for questioning on his means and assets. A court officer (not a judge) will ask him a list of relevant questions and require evidence of earnings, expenditure, bank accounts, etc., and you will be able to request some other relevant questions to be asked on your behalf, if neccessary. This should provide a basis for you to enforce repayment of the debt by one of the means sanctioned by the court. I am not good with computers so cannot provide a link but if you Google HMCS and find the section on Forms & Leaflets you will be able to fill in and print the necessary form. Good luck.
