i having my so for a week if i keep him wil i get arrested or will she have to fight me in court to get him bk we are both on his birth certify and we both have parental rights for him any help would be great fuly apprictiated

why would you do that?
how can you kidnap your own child, K8?
if she has a residence order then yes you can be arrested in contravention of that. Any sensible mum, if you kept him, would simply get a court order for residence and it would look very bad on you that you stole him. A much more sensible way forwar would be to take it before a family court. Even mre sensible would be to talk to the mum, of course!
That s a civil matter not a criminal one.

You are both on the birth certificate. This seems like a verbal agrrement between yourself and the son's mother so you can have him. If you don't give the son back of course it is not kidnap because you are the father of the son!!

The other person will probably be annoyed and try to get him back of you but you won't get arrested. You are the father afterall
ok seems I am wrong, but I think that thats an awful thing to do, unless you believe the child is in danger living with its mother. Just out of interest how old is the child? Who do they want to live with? (if they're old enough to understand) and how would you feel if the mother took your son away from you?
personally you will not being doing your self any favours whatsoever by doingt that and secondly why on earth would you do that unless the child is in danger in his mothers custody?
Because maybe he wouldn't mind seeing a bit more of his son?
