gbh with intent
4 Answers
hi not long ago my friend was in an incedent where he grabbed a guy round the chest area but left his one hand free, alot of people have told the police different stories about him some in which are not true and now this has lead to him having to go to crown court with a charge of gbh with intent... my question is is this erious enough to deserve a title of gbh with intent? and is there any chance of the charge being dropped to abh or common assult? as it isnt that serious to me. he is concerned as he has a child and does not want to go to jail. this is his first violent offence and he regrets it deeply and was very drunk at the time. please get back to me asap thanks rachael x

The staff of the Crown Prosecution Service aren't idiots and they wouldn't decide upon a 'Section 18' charge unless they believed that there was sufficient evidence to obtain a conviction upon that charge.
The CPS has produced guidelines for its staff, indicating the appropriate type of charge for the different types of assault. You can be confident that the person who decided 'GBH with intent' to be the appropriate charge is fully familiar with the contents of this document:

Click on each of the relevant links to see the differences between 'common assault', 'ABH', 'GBH' and 'GBH with intent'.
Nobody here can advise you as to the likelihood of the charge being dropped to a lower level unless we're provided with full details of the victim's injuries and the detailed circumstances of the assault (including, for example, whether a weapon was used)
