Is you are already in touch with a solicitor I would ask them any further questions. They can tell you what constitutes an assault and who they will need to talk to about what happened.

In the longer term, assuming your son did not commit an assault and the prosecution is continued he will presumably be advised to plead not guilty and face a trial.

"assault by beating" covers offences that involve ANY contact between 2 people, including spitting!
