who is responsible for the upkeep of footpaths on an unadopted road (BOAT)?

I live in rural Oxfordshire on a glorfied public footpath, known locally as 'the concrete road', offically it is a BOAT (by-way open to all traffic). The footpath is in poor condition, there is also street lighting. Who is respobsible for repairing the footpath, the house owners or the local authority (county)?

For more on marking an answer as the "Best Answer", please visit our FAQ.I think if it's a relatively new road/footpath the builder maintains it until the local authorities take it (adopt) over. In practice though this rarely happens. Builder gets their money and away they go.
If its an old road/footpath then there are a myriad of problems.
