I have just been reading in our local newspaper about a bloke that was remanded in custody for almost 2 months, when he went to court he was found totally innocent of any involvement in the case, so my question is would he have any redress or claim against the police for false imprisonment.
it's not false imprisonment if they believe he was involved. If that were the case EVERYONE who was remanded, then found innocent at trial would be suing the police left right and centre
I can see everyone's point but on the other hand put yourself in this poor blokes place
he has had his freedom taken away though a police mistake, and like it or not the poo
sticks regardless of if you did the crime or not.
Remands in custody must now be very rare. I think a judge is obliged to grant bail unless there is thought to be a serious chance of other offences, a likelihood that the accused would not turn up for their trial, or because of the gravity of the offence.
If the accused is acquitted at their trial then the fact that they were remanded in custody is just bad luck.
