How much does Cognitive Behavioural Therapy add to a PI claim?
7 Answers
Hi, I was in a road traffic accident. I was offered £1,800 before I was diagnosed with Ptsd, which I then had 10 sessions of CBT and EMDR. The final report has been written, but have waiting weeks now for an offer to come through, how much more from the 1,800 am I likely to get after all this Therapy treatment?

To start with - When you say you were diagnosed with PTSD - Who made this diagnosis ?
Did you have a consultation with a psychiatrist / psyschologist , who made this diagnosis and recomended CBT ?
When you say the final repport has been written - who has written this final report ?

A pyschotherapist diagnosed me and gave me the 10 sessions, she wrote the final report to say the 10 sessions were enough and that I no longer require any more CBT help. And yes my primary concern is now how much money I can be compensated after loss of earnings and the cost of alternative ways of travelling without car, since the driver was at fault with careless driving, I think I am very much entitled to more than money, he's robbed me of many things in two years.
I would say nothing.
CBT (EMDR is a new one to me) is a place I'll think you'll find a lot of people have visited for various reasons. Not to manipulate a system for financial gain though.
It's been mentioned you've not provided details so how can anyone advise?
In fact all you have done is demonstrate a desire to financially screw someone for all you can get.
Did anyone die?
Did you lose an arm, a leg, break your back, your neck?
How have you been robbed?
Did the careless driver scratch your cars paint?

clearly the posters who have been so rude don't understand the affect ptsd can have (perhaps they think it's made up?)
Anyway. You should at least be compensated for time you had to take off work to attend treatment and any money you had to pay towards treatment. You need to look at it like a broken leg: something was wrong, but now it's fixed

It is unusual for a psychotherapist in a case like this , to have diagnosed your symptoms and report that you have PTSD .
What usually happens is that a GP Specialising in medico legal claims or a Consultant Orthopod or a Consultant in A & E , examines the claimant and reports on , and gives a prognosis with respect to the physical injuries sustained .
If you advise him / her that you are experiencing psychological symptoms , which are not the usual normal expected reactions to the event - eg anxiety , apprehension etc ; but of a more serious nature eg nightmares etc - then he/she would refer you to a Consultant psychologist / psychiatrist .
The psychiatrist / psychologist would then , after a consultation with you , compile a report , which would advise if in fact your symptoms fell within / outside the definition of PTSD ; and would recommend what , if any treatment is warranted .
If PTSD was diagnosed then a psychotherapist would provide you with the necessary treatment recommended .
In cases where PTSD is diagnosed by the aforementioned experts and depending on the prognosis - then you would normally be expected to have a higher award in terms of payment made to you - as opposed to an allegation only , of psychological symptoms
Without knowing the details of your case it is difficult to estimate how much extra you would be expected to receive .
You should also bear in mind that the amount that you receive will also depend on how good the person acting on your behalf is in pursuing / negotiating with the compensator .
At the end of the day , you could have shed loads of evidence - but if those acting on you behalf aren't robust in pursuing your claim, then you could end up with less than your case warrants .
Defendants will always attempt to get rid of a case , as cheaply as possible
