Residnet parking laws
hi,
right the scenario is we live in some flats owned by a housing comapny,behind the flats there is 3 spaces in the residents parking area a turning bay what can fit a car but if a car is left there its quite annoying to get your car out as you have to jump up a kerb. just to add there is 5 flats here and 3 / 4 spaces and 5 cars to park, there is also a car park to front of house which is free all the time. the spaces behind the flats are through an archway aswell, which is just big enough to get a car in be lucky if there is 4" each side of wing mirrors.
so there was 3 cars in all the bays, i park my car in the turning bay as i'm out 1st in the morning, thus i dnt make it akward for any 1 to get out.
just as i was getting some late night snacks i saw another neighbour has parked her car in front of mine making it imposible for all the cars to get out untill she moves. i have written to the housing association, waiting on reply but they will probly just send a leter out to every 1 asking to be more civil about parking.
she has done this before and when i tried knocking on her door @ 7:45 when i needed to go to work she never answered and her door bell was not working, this made me have to phone my employer (my dad luckily) to come over and pick me up as i was blocked in.
apart from asking her when i next see her or putting a note on her windscreen what else does the law entitle me to do?. I have a friend who said he would gladly get his land rover and just pull it out of the way but i know if the car hit the walls we would be responsible for criminal damages, i also thought about some trolley jacks and wheel it out and dump it in middle of road. can i get the police involved or ask for there asisstance to move it?
sorry if i drivel on a bit but this is starting to annoy me now and i dont see why we should suffer not being able to use our cars because of the selfish act by a lazy person

Since it is private land, the law doesn't enable you to do anything about it - which is what you asked in your question.
You either have to persuade the owner of the land (housing association) to take action, try and agree with her and the other owners what to do about the problem, or park elsewhere.

she doesnt park in the turning bay she basically parks in the exit/entrance and as i'm not blocking any 1 in or causing a blockade my parking is not inconsiderate. also the other drivers are in b4 me so they get there cars in and park there cars so there front facing ready to go so they dont use the turning bay when they need to go. i would have no prolems if she was able to get up in the morning to let me out but she doesnt
if the parking was full up i would park over there, kinda like 1st come 1st serve basis as you would normally operate, but she like ohh its full i just abandon my car in the exit

Since it is private land, the law doesn't enable you to do anything about it - which is what you asked in your question.

Personally, as you aren't in a space and are parked where you shouldn't be anyway, I doubt you've got any moral high ground here. However, the three others similarly blocked in who are parked legally presumably do. As someone else said, what if there's an emergency? She shouldn't be blocking the car park.
I don't see why everyone is so desperate to park at the back if there's surplus spaces at the front? What's the problem with the front?

the front car park used to be owned by a cooperative store that closed down but no 1 bought the car park.
i also stated in my insurance i park in residential parking and i know for a fact if my car was in other car park and was broken into they would say it wasnt in resident car parking and not pay out.
Also as stated as every 1 has already got these cars in they are forward facing so i dont block them in in any way possible.

Yes, you've said that twice now. Never the less, you are NOT in a designated space and so, parked where you shouldn't be, she owes no duty of care to you. As I said though, she does owe it to the others she is blocking in. Perhaps her insurance also says that she parks in a residents car park overnight?
At the end of the day if there's five flats and three spaces then you cannot inevitably guarantee that you will be able to park there overnight. You don't have designated rights to a space.
The answer to the question you initially asked remains "nothing" though. In law there's nothing you can do to force her not to park blocking you in. It would appear it's a private car park and all five car owners have the right to try to park there. No individual has any guarantee of doing so, nor of not being blocked in having done so unless it says something different in your lease?
