Ex husbands!!

Hi i am asking on behalf of a friend who has split with her husband.
He has moved in with a new partner and she is currently seeing someone else, shes kept on the house and looking aftee the children with out any support from him. They have been sorting through bills and debts and trying to get him to take on his own,. They had 2 cars, 1 which he bought for her and a family car that that they shared, when they split he took the car he bought her as she still needed the family car to take the children to school etc. this car is in his name, and he has recently threatend to come and take it or report it stolen to the police. My friend pays for the tax and insurance on both cars and always has, Just needed to find out realy is he can do this and could she get in trouble if she gets stopped off the police??

She needs to get a solicitor involved, really to deal with ALL their assets. It doesn't matter if the registration document is in his name - the registered keeper is not necessarily the owner.

If the car was bought during their marriage then it is normally classed as a common asset (i.e. they both own it), just as the one that he took with him would be. If he reported it stolen, knowing full well that she had it, he could certainly be prosecuted for providing a false statement and wasting police time.
If he's not going to play nicely and come to a mutually agreed settlement, then she needs professional advice to fight her corner and make sure he doesn't take everything.
