What will happenen if you are caught drinking a soft drink whilst driving but was stationary at a red light at the time
Is this illegal and does it result in penalty points

there have been cases of people prosecuted for eating apples and sandwiches whilst driving.. not being in full control of the car, or something like.

if you're driving in the rougher end of town
while driving maybe; while stationary I would have thought not. Fight it.

"Not in control of the vehicle" when you are stationary ...

... would be stretching the point somewhat !!
why soft drinks? you can drink a can of lager if you like. As long as you remain under the limit and in full control. Same as the soft drink.
Whilst stationery too.

You are diverting some of your attention to eating/drinking rather than attending to what the lights/other traffic are doing, hence you are not in full control.

There have been successful prosecutions.
I'd still fight it.

Depends on number of things, 1 being the copper and his discrestion. Could be classed as driving without due care and attention or as already said, not being in proper control.

Bottom line is, should not even risk having drink whilst driving, regardless the lights are red and car is not moving.
