also if it has a jury, knowlegde of a tape, whether they hear it or not, is evidence in itself

i think an employment tribunal is different from a court of law anyway. you need buenchico to answer - he seems to know what he is talking about when it comes to taping coversations

one is allowed to record any conversation in which they are a party and it can be used as evidence in court if allowed by the judge hearing the case. Proving it was your boss speaking may be a hurdle so be sure and identify the parties on the recording
