Affray and GBH sentencing
Hey, Me, my brother and two cousins were involved in a fight (self defence as he had a bottle and started it all but the cctv is very unclear and it looks as though we just attacked him and cannot prove he had a bottle). We was charged with GBH with intent because he had 6 stitches in hes ear, Only me and one of my cousins even got involved. My brother got off and me and my two cousins pleaded guilty ( Me and my youngest cousin affray and my elder cousin gbh section 20 ) My youngest cousin is getting probation etc because he was 16 at the time and it's pretty clear he didn't hit anyone. Just wanted to know what sentences me and my elder cousin would receive (bare in mind the judge seems to be gunning for us :( ).

It's difficult to say but you must remember that GBH of any degree is a serious crime.
CCTV shows 4 lads assaulting one lad who may or may not have had a weapon. Without knowing the full details it can go either way. However, I would suggest a fine and suspended sentence of 2 years for the affray and a custodial sentence of anything upto 6 months for the GBH.

In my honest opinion Nosha123 it's even more insulting to sarcastically insult someone's family when said family is having a difficult time due to the likely hood of members of it's family being sentenced to prison for merely defending themselves. I care very much for my cousin that is going to prison hence anyone insulting him will not be greeted kindly :). On a more positive note thank you for your reply wizard it's appreciated.

Sorry i aint checked this in a while. Mmm my younger cousin the judge has already said would be dealt with at a youth court instead and has stated that he will not get a custodial sentence. We pleaded guilty because otherwise we would of all been charged with gbh with intent because we apparently was all kicking him on the floor for 30 seconds ( this is ofcourse rubbish the bloke is a wannabe gangster that is going for a claim/compensation in my honest opinion) and i wanted to get my brother off and my eldest cousin didn't wana risk getting sentenced guilty to gbh with intent as it carries a heavier sentence and the CCTV doesn't show the bottle. And as for the judge comment he wouldn't give an indication as to what we'd be sentenced to if we pleaded guilty and then tried to do a newton hearing or something where we'd of lost the 1/3 reduced sentence so in the end we had to say we was kicking him even though the cctv doesn't show this but hey ''justice system works''. I personally wanted to fight the case but it was better overall for my family to go down the road we went with the judge we had. Bare in mind we all told the truth without a solicitor when questioned at the earliest possible time (in police questioning).
