can i be arresred for fraud?

Hi.
I hope that someone can help me, please.

My marriage has recently broken down due to several instances of my husband being violent, this has included him being arrested.

Over the last 15 months I have had permission from my husband to use a Littlewoods catalogue account which is in his name. This account has been paid monthly via our joint bank account, and we have purchased a Fridge freezer and also a pushchair.

Since the last incident of domestic violence he has constantly issued me with threats that he 'will have me sent to prison if I kick him out' (The tenancy to our home is in my sole name and as we have 3 very young children I really am not happy with him being here).

My question is does anyone know what will happen? The balance on the account is 600 pounds. I can't eat or sleep properly because I'm so frightened that I will end up in prison and will lose my darling children.

Not a hope in hell. If you are married all debts are in joint names.

I have said to my husband not to pay any maintenance and to clear the debts first.

He is very manipulative and has the ability to scare the hell out of me.
You should see a solicitor as soon as possible. If you do not the situation will only get worse.

I'm scared evenmore now.
If you have any problems with debts go to the Citizens Advice Bureau. They are very good and have helped me out a lot.

I don't have any problems with debt, my husband has said that he will sort out the debt in his name and I am not to go anywhere near it.

All I can think about are my 3 children, they are 5, 4 and 1 and the thought of losing them is terryfying.
I can understand that. But you will not be arrested for fraud or anything else. Violence is a criminal offence, domestic or not. You seem to have a good case. See a solicitor Monday morning is my advice. You don't need to tell your husband what you are doing.

I'm going to see a solicitor on Monday and am not going to be bullied and manipulated any longer.

I don't see how this is fraud unless you've been pretending to be him, or forging his signature? it doesn't even sound like you've bought anything for your own personal use.

I think he's full of hot air, and a bully. see the CAB but don't worry about this.

It's not fraud. All they need to do is look at what you purchased.

I have bought things for me and the kids, but with his permission. It's pretty difficult to shop for things for me with the 3 kids running around, that's why he opened the account in the 1st place.

At Christmas he was arrested for a pretty nasty attack on me. He wasn't allowed to come home (his bail conditions) and he used the money we had saved for Christmas presents on hotels and such like, so I contacted him and he gave me permission to get the kids presents from there.

The account is paid from our joint bank account so he can't really say he didn't know.

he's just bullied you into feeling like this when it's not necessary.

look at him as the idiot he obviously is.
It's not fraud....simple.

Just to make you all aware, the OP opened multiple catalogue accounts in my name without my knowledge and had them for in excess of 18 months. This was because she wasn't able to open them in her own name due to a terrible credit history. I only found out about them when applying to switch my credit card to a 0% balance card and was refused as these "accounts" showed up and there were multiple payments missed, pretty much shredding my credit history.

The "washing machine, fridge freezer" etc, were bought BEFORE she started opening other accounts without my knowledge, ordering women's clothing in numerous different sizes and selling it onto friends who like her could not get credit.

The "attack" happened when we were on a night out and my drink was spiked, by someone that she was having an on-going dispute with and I had no control over my actions (the fact that I got bound over for £100) testifies to that.

Something else she failed to mention was during all of this, she was having an affair.

Save your thoughts for someone who actually deserves it.
