My son was charged with GBH about 2 years ago. There was no proof against him and the charge was dropped.
Last night he was randomly stopped by the police,he gave his name and the officer told him that he was once charged with GBH.
Is'nt this charge was supposed to be off his record.
What can my son do to get this removed from his police record
Thanks if anyone could offer some advice
I shouldnt worry too much. Most police forces have local intelligence records on which are recorded all sorts of information that may be of use to patrolling officers who may stop people on the street for rouitine checking. This local intelligence does not form part of a persons criminal record.
He can do nothing to have it removed. As Gladeian says, police forces keep this sort of information on record. Despite the prosecution being discontinued it is a matter of fact that he was charged and this is what the police record says.
Unfortunately it will never be removed from the police database. It will come up if he has to do an enhanced CRB check, but that is only for teachers, policemen, positions in national security and high positions in financial institutions. It will not come up on a standard CRB and obviously does not count as a criminal record.
If I was him I would make a counter-accusation of attempting to pervert the court of justice against the person who made the false claim against your son.
