Failure to Update Log Book - Bailiffs Expected
14 Answers
Hi, I am looking for some advice after a I received a phonecall from Marstons a couple of hours ago.
In short they said I owe £525 for failing to update my logbook and that unless I make the payment in full they would instruct the debt collectors.
I recieved a letter a week ago on saturday, from marstons saying I need to pay £525 for an unpaid debt, no details of what. I called the number straight away only to hear an automated option to pay with my card. Knowing nothing of any debt, or of marstons, I presumed the letter was a fraud and threw it away.
I asked Marstons what the debt was for, and they said it was 'failure to update logbook' and no more details.
They said I should call the court tomorrow morning which I will do.
I left my wife and 3 year old daughter a year ago, after discovering my wife's multiple affiars. At the same time the business I had ran for 11 years went down. Not the best of years for me and I suffered heavily with anxiety & depression. I am still unemployed although I am actively seeking work.
My wife (soon to be ex) has been useless at passing on post.
Can anyone shed some light on this matter? I certainly cannot afford to make a payment of any amount based on my income from 'income based job seekers allowance' of £65 per week.
Kind Regards
Andy

Maybe this is it and if it isnt I dont think you can say your wife never passed the mail onto you as you should have changed your address then you would have received any mail relating to the matter. I think you will just have to wait until you ring court.

Thanks everyone for the replies. Much appreciated.
Sorry If I was unclear about the log book, I spoke to the court who confirmed this is a failure to update a log book on a car that was written off. Yet to find out more details though.
Court advised that I make statutory declaration that I have had no knowledge of this situation until now. The failure notice was from August 2010. Went to the court to make this declaration twice on Friday, booked an appointment but both times they were too busy! ;)
I was also told that the fine is £250, and the remaining £275 was added by Marstons Debt Recovery Group.
Court told me that once my declaration was in place, marstons would be called off, and the proceedings would start at the beginning again.
So I presume that I am being fined for failure to update a log book. Hopefully this will not incurr the £250, as if I was means tested my income (job seekers allowance) is not sufficient. Any feedback on this point would be appreciated. How can they take money I don't have?
Many thanks again.
