Three of us work a rota of three shifts over three weeks at a private members club; It seems that they might want to close the club on Bank Holidays eg Good Friday, Christmas Day etc. and they are hinting that whoever is on duty on the bank holiday will be told that they wont be require to work and will therefore not be paid. Can they legally do that? our contract does not say that we can be laid off whenever, without pay. We are not casual workers, pay PAYE etc and get paid via bank transfer. Thanks for any advice.
If you are on the staff then you are entitled to pay for Bank holidays, whether or not you usually work them - the rules changed a while back, particularly for part-time workers who were always disadvantaged if they didn't work Mondays, so never got Monday BHs. What does your contract say about annual leave? Ours say, for instance, that we get 20 days' holiday + 8 BH = 33 days, so we can take the 33 days off whenever we want.
The 5.6 weeks figure is the statutory minimum. Many employers offer more holidays than that.

Boxtops is correct. I get 33 days because I work 6 days per week and I can take them whenever I want. It should say in your contract you get 5.6 weeks holiday and you should be able to work out what your holiday entitlement is by the amount of days you work. It doesnt matter how many hours you work in that day, it still counts as a day. We had a part-time employee who worked 4 hours a day, 2 days a week and she was entitled to 11.2 days holiday for the year.
we have part time people so I either give them 28 days and they get average weekly hours x 5.6 divided by 5 fr each day they have off, or if they want a normal days wage they get less days. Its easier to give them it in hours otherwise all people would be taking days off when they have double shifts.
