Has Anna legally adopted Fay? if so surely the real parents are not allowed to even know where she was living? let alone apply for custody, or am I way behind in the law?

Yes, she has legally adopted Faye.
No, he cannot apply for custody unless Faye is put in to care because she is being ill treated/neglected/abused at home.

He seems the type that would prefer to be the sort of dad that is good for treats and days out but not the hard work, commitment and restrictions of full time care.

I wondered about that, as he now has no legal right to be a part of her life until she is 18 but the storyline has Owen playing into her hands, I also am surprised at how the father is appearing to be so very reasonable when he has not seemingly had contact with his daughter for 10 years. I am not convinced with his motives at all.

Maybe he is angling after getting rid of Owen and moving in on Anna, thus becoming a family to Fay?

Yes, it is. She was formally and legally adopted in November 2011 when her name changed to Windass.
