Likely Outcome From Police Interview

Myself and 2 of my friends were involved in an argument with another gentleman in a fast food restaurant some 4 weeks ago on a Saturday evening.

There was a bit of an argument going back and for and I stepped in between my friend and the gentleman and directed my mate to the exit and tried to cool the situation. The gentleman we were arguing with said something very insulting and I reacted and grabbed him by the neck and pushed him back and told him to just leave it. We had a bit of a push and a shove and he slipped to the floor but got straight back up. My other friend was arguing with another guy and I went over and pulled my friend off him and we left the premises.

The police picked us up some 10minutes down the road and did not arrest 2 of us and just asked for ID. One of my friends was arrested as he was resisting arrest and was very verbal with the police. The Police officer asked us to leave the area and return to our homes and if we didn't he would pick us up.

This was some 5 weeks ago now and yesterday I recieved a call from the Police and asked whether they could formally interview me in relation to a possible Section 3 Affray and Section 4 public order. I called my solicitor and he has set up the interview for tomorrow and has said the officer wants me to watch the CCTV footage and give my account on what happened.

Slightly worried now, I only have one previous offence for Drunk and Disorderly back in 2005 that resulted in a court fine of £75. Will the police take this into account?

I am 29 years old and have a professional career and I don't really know why I reacted like that. I am usually pretty calm and collected. No punches were thrown and the gentleman is not making a complaint either.

What would be the likely charge and outcome here?

i don't see how a past event 10 years ago could be relevant to questions about something htat happend 4 weeks ago.
If they are questioning you about Section 3 Affray and Section 4 public order then i guess the cahrges (if any are laid) would relate to that

The statement in relation to my previous conviction I was noting whether the police will use this to show I have previous run-ins with them or will it be ignored as it happened a long time ago.

It wasn't really a brawl, it lasted probably 20 seconds and was only a push and a shove and everyone went there seperate ways.

The police will not be interested in your 'previous'. The only time it might become relevant is if you are tried and convicted, then it could possibly be taken into account when sentencing.

it will depend on what you say in your police interview

very sensibly you are going lawyered up
so make sure you listen to what your lawyer has to say
( and not us: he will have seen CCTV which we havent )
