It seems more and more that The Establishment consider the perpetrator to be the victim. The real victim is of no consequence to them. I honestly dont think they have a clue about how this can affect normal hard working tax payers.

No, Nick Knowles is not right, although I entirely sympathise with the situation on which he is commenting.

The law works purely because it is dispassionate, and emotions are not used in its creation and implementation. Bringing emotions into law creation and implementation is not possible because it simply sees judges out-doing each other in expressing their moral outrage by out-sentencing each other.

If there are faults with the law - and there certainly are! - then the faults like with the legal system at source, and not with the judges who are bound to deliver the sentences laid down for them.

But haven't we seen the opposite where right-on liberal judiciary seem to compete for the lowest (or no) sentence?

But even there guidelines are given but all too often the most lenient sentence is picked for the flimsiest of reasons.

sentences are not laid down, per-se, but the judiciary has sentencing guidelines from which to work. judges determine sentences based on precedent case law.
