PLEASE HELP. My partner is trying to make a counter allegation of assault, but has been to 2 Police Stations and both will not take it. Basically what happened is my other half was drunk in a pub which he does not know, his friends had gone home and left him. One of the locals offered him out side (even now neither parties can remember what led up to this) any way it was a what you would class as a fair fight my partner stopped when male fell to floor. Land lady is saying he stamped on the lads head and he is now being done for sec 18 ( bearing in mind this other man only had a black eye and a small cut to back of head) the day after my partner was realeased his knee swelled up and has bruising all down shin. My partner lives down south and was up visiting me in the North West at the time of incident. My partner is due to be leaving to go to Afghan this week and needs to get sorted, he has taken advice from solicitor but to no avail. He has been to doctors and this is noted on his record

If they can't remember what led up to it are you sure he can remember that he didn't stamp on his head?

yes he is not the type of person to do anything so low, and also has a witness who saw everything but will not get involved and does not want to go to court
Hmmm...alcohol effects people in different ways and the police will know that. They will take the word of the ladlady first.

When it comes to his knee how can he prove that it happened in the fight? How do they know he didn't fall over on his way home..drunk?
So neither party can remember what lead up to the fight, but your OH wants to make an allegation of assault?

They dont do they!!! I am asking for advice, can the Police take a counter alleagtion or not? And just so you know this other male has got previous for assault and has only recently been realeased from HMP, AND is well known by Police.

If he is off to Afghanistan presumably he is in the Forces - had he better not speak to them?

Speak to who sorry??Police are aware he is going away and is on bail till March.
If he is in the armed forces and about to go out to Afghanistan, his bosses will not be best pleased if he is in trouble, they may not allow him to go because he has shown a lack of judgement and discipline.
Speak to his CO of course. If he has a gammy leg as well, they may notice this and ask anyway

He is allowed to go to Afghanistan boss is fine with that as he was only home on 2 weeks leave.
So when is he bailed till?

Has spoke to CO untill it goes to court he is not bothered and depends on what he gets found guilty with that will then decide his punishment.
He has told his boss he has a section 18 outstanding?

until March he was ment to be flying out last week but flight was cancelled
he is never off duty if he is seving personel and so he can expect to be doubly punished. Are you sure this person is the right one for you?

The CID officer dealing with case spoke to his CO and explained everything then my partner had to do the same when back on camp
