Private Prosecution Of A Serving Uk Police Officer

I have a disabled son who has suffered continual bullying for several years. The police are always in denial about this bullying and think it is ok to let the thugs off every time by creating various excuses. After a web page was made about my son containing disability hate comments, we made a complaint about it to police. The stalker took several hours with lots of care and attention using photos of my son which she changed to make him look feminine. We asked the police to get it removed but they kept insisting it was simply a face book matter. My son got fed up after several weeks and had made a private comment to the publisher’s boyfriend saying he would jump her if the site did not get taken down. He made the comment to him not knowing it was the stalkers boyfriend. He only said what he was thinking in anger and did not say to pass the comment on as threat, however police now want to speak to my son and give him "words of advice" which amounts to an admission of doing wrong. I can predict the police are attempting to again let the offender off by telling the CPS they gave my son words of advice and so the same should be for the girl. Problem is what my son has done is not an offence but the police are adamant they want to pursue him over it. I strongly believe this is being done only to allow this stalker girl to walk free from charges. I believe this is perverting the course of justice. After all my son who has now suffered in excess of 200 hate crimes including 2 sexual assaults and a stabbing without anyone being ever charged. I want the girl prosecuted and may bring her to a civil court, but how can I prosecute privately the police officer. Do I need special permission from the attorney general.

I have no idea, but I suggest that your best course of action is to take legal advice now - I have no idea why you and your son have left it so long to do anything concrete about this. See a solicitor.

There seem to be 2 matters here , the facebook page , which I think is a matter for facebook who should take it down and warn the poster. Have you reported this to facebook and if so what was the response?
Then there is the far more serious matter of the assaults and stabbing , what happened about these ?
I assume they were reported to the police , what happened ?
You have NO grounds to report the police officer who asked to speak to your son. He DID make a threat to ''jump '' the girl, that is a crime. I realise it was made under duress but 2 wrongs do not make a right .

Hi thanks for your replies. With a reply to Boxtops, we did report this to the police when it was known about, which was around 3 months ago. The publisher has been involved with the bullying of my son for several years. She is at the heart of this bullying and has many family and friends in the immediate area that have been involved in this long term bullying. Believe me we have followed all the usual routes trying to deal with this issue using police school staffs, complaint procedures are coming out of our ears. The police involvement has been horrendous but they did not help us by going after the attackers instead they took sides with them, so let's be clear about that. Thank you EDDIE51. We did report this to face book several times and through more than one person but they did nothing. We reported it again and again. Eventually face book removed some of the photos but she simply re published them again. So to be clear even after many clear explanations face book did nothing until the police got called by us again on a second log number which again was weeks after it was first published. When it was first published, my son thought the page was made by a boy he knew. He knew the boy was mixing with this girl who had caused him problems but not that it was her boyfriend or boyfriend to be. He said to him in a private message after the boy told him who wrote the page "I swear down I will jump her if she don't take it down. Remember this is him talking to a third party. He did not write "tell her I will do this" or tell him to pass any threat to her. I should have mentioned he thought this was ok because after he had suffered many third part threats himself which the police came to our house about several times, they told him it was not an offence to write something threatening others in a third party way and that there is nothing he could do about it not even visit them. So now the ball is on the other foot and my son was convinced that what he did was nothing wrong. You need to understand the police have been finding excuses to let off the 100 or so thugs that have continually attacked my son every time he leaves the house. Each time there is an incident there is either no evidence or a counter claim of some reason. Now my son has learning difficulties and these kids do these things to him to get a response and then gang up together, change the story and all back each other up. The last time he saw the girl who made the web pages she was with a group of 11 other youths who attacked my son and she got hold of him with them and tried to break his fingers by bending them back. In fact that’s how she learned he had deformed fingers and nails. If the reply that you made in correct then the officer that told us he could do nothing about the numerous threats my son had made to him then he was lying and we should then consider bringing him into court for perverting the course of justice perhaps? I would like people reading this to understand that the police are the issue here. They have effectively ignored the constant attacks to my son because it causes them to look bad if there is lots of trouble recorded in the area. They actively refuse to help us and this is why I feel action needs to be taken against them directly.

Sorry I forget to answer about the assaults stabbing etc. The police did nothing and the second sexual assault involved a policeman’s son who was with a gang of others who lured my son to the local park then attacked him with violence and tried to force his penis into my sons face. The police allowed the policeman’s son to use the other attackers as his witnesses again. So nothing is the answer, as is per usual absolutely nothing. When my son tried to hang himself because he could not cope with this continual bullying they blamed us, his parents. Disgusting people Wiltshire police.

You need to get hold of a solicitor on this and detail all of the complaints against the police and the lack of action.
If what you say is true then there has been serious misconduct by the police and it needs urgent investigation. This far too complicated to sort out on a site like this, you need expert advice from a qualified solicitor.
Taking the police to court and trying to sue them is not the sort of thing a lay person can do easily , they will make excuses and try to put you off as they have done with the complaints about bullying and the assaults.
Please go and get proper legal advice urgently.
