Will a GBH section 20 caution always ever be spent
4 Answers
When I was 23 years old I had an argument with one of the lads I was out with on a bank holiday. He became aggressive towards me I panicked and punched him. He is the same age as me and I had known him for about 4 years. After the incident I stopped going out with the group of lads, most of whom I had known since school. 2 months passed then I received a visit from C.I.D. who told me that he was pressing charges but that he did not want to go to court apparently he just had to report the incident to claim criminal damages. The problem was that the 2 other lads who intervened in the incident after I punched him hadn't witnessed the build up, or the punch I threw, and I was told that I had broken his jaw when I punched him. They therefore recommended that I accept a caution and that it would not prevent me from getting jobs in future. I was told that if it went to court I would probably do time.
I accepted the caution believing that that was the end of it; however, 2 years later I was asked to fill in an enhanced disclosure form and a GBH section 20 caution showed up. Obviously, my employer wanted to know what it was about after explaining they were OK about it as I had worked there for almost 2 years and they knew me. I was very disappointed though as I was studying for a teaching certificate at the time to teach the subject I have an Honours degree in. It has now been 6 years since I received the caution and I have almost finished my Masters degree. I was wondering if this caution will always show up on disclosure forms as I would like to be able to apply for jobs with other employers. I have read on some sites that cautions are deleted after 5 years, but other sources state that cautions are never deleted and will always show up. Is there any hope or will I always be restricted in the jobs that I can apply for?
