Wingnut??? another question re: Car Accident

If your car is in an accident ... is it the driver's responsibility or the owner's responsibility to pay out the other vehicle?

It's the responsibility of the person's whose fault the accident was. They should have the correct insurance to drive said vehicle in first place.

If it was not my fault and the other vehicle was a rental car (which says that it has insurance on all vehicles) then do I go to the rental agency or the driver?? (the driver was a tourist leaving the country) is it the owners responsibility?

The Rental agency says I must sue the Driver and it is not their responsibility - but I always thought it was the Owners responsibility

I think I may not be of much help to you I'm afraid as I am no expert here but what has your own insurance company said? Surely if you have given them all the details then it is down to them to try to sort this out as it is what you pay them for. Has the other driver admitted liability? Just wondering as well with it being so early in the morning when you posted this, are you in the UK as this is a UK based website and what happens here may be different to what happens in another country.

There are lots of Aber's here who will be able to help you who know more about this type of thing. However I think you may have to wait a few hours as they are probably still tucked up in bed :o)
