Monday - Motorbike purchased;
Tuesday - Motorbike passes MOT;
Thursday - stopped by Mr Plod - he can't see a visor on the helmet, it is there; then proceeds to examine Motorbike.
Doesn't like look of exhaust pipe; checks B.S. Kite-mark and stamped number which transpires to be bogus ! Policeman decides that this invalidates MOT which invalidates Insurance which means an offence has been committed.........
Impounds bike which gets sent away to be kept as evidence and will be used in forthcoming court-case ! It will cost 250 to pay for retrieval of bike and is costing 12.50 per day to keep bike there. Bike is only means of transport.
What offence was committed ? What can be reasonably expected as outcome ?

Thankyou for your kind and considered words. These are of great help and comfort to someone experiencing real difficulties at present.
Obviously 007 doesn't like or has ever had the joy of riding a motorbike, all men die but some never live.

The MOT test is a test of roadworthiness, your bike was roadworthy, how a bike can be impounded for a loud can I don't know.

You can ride a Bike with no visor on your helmet.

You need to get a solicitor and sue the police force involved.

Thankyou, Toureman.

This was also my reading of the situation, but as there have been an additional 3000+ offences added to the statute books over the last 10 years I wasn't certain that I was correct.

many thanks
I've had the displeasure of riding and being the passenger on many bikes over the years and have come to my opinon on bikes through experience and not notion.

4 Wheels better in my opinion - sorry for the flippant answer Jack !
I cant see how a bogus registration marks can invalidate the MOT certificate after all it was examined and passed the test, But you need to remember that the certificate is issued on the basis that the vehicle complies with all releavant test legislation and that in the opinion of the examiner is fit to be used on the road, But that doesnt stop you being stopped at a roadside check and your bike failed especially if you had altered it in anyway since the test (some people borrow tyres to get them through the test and then give them back) I know that lack of road tax invalidates your insurance and now it seems that the lack of an mot certificate does too,

I would challenge the decision because the policeman has overridden the decision of the authorised Mot Testing Station. If necessary get a solicitor on the job
Your probably falling foul of the 'Constructions and Use' regulations, What have you been charged with?

In response to GrahamJnr if you have no MOT then you have invalidated your insurance, its in the small print.

Thanks, Slack.
I posted this on behalf of a neighbour who has since moved. As quite a bit of time has passed, I can only assume that it was all resolved satisfactorily.
