A car (*****head neighbour) is parked (illegally) in a disabled bay. They have intentionally (I am POSITIVE)parked my husband in. The Q is: If my husband dented their car whilst pulling out ...whose insurance would pay? surely is the illegally parked car's fault? I Will also be posting a Q regarding the illegal "lending out" of disabled bay in Legal under a seperate title. /

Unfortunately, it doesn't matter whether the car is parked illegally since stationery vehicles do not hit anything. So if your husband did dent the vehicle, it would be his insurance that would have to pay.
Are you saying that if a genuine disabled driver parked there it would also block your husband in,or have they parked badly within the disabled space?
I think you would have to call the police to remove the car rather than dent it trying to get out.

Whether the car is parked illegally or not is irrelevant - if your husband hits the other person's car it will be your husband's insurance.

Is this disabled bay on a public highway or part of a car park or residents parking area?

Not sure whether it can be classed as "illegal" depends on who polices the bay.

Ummmmmmm there is hardly a hairs breadth. REALLY close. My husband will TRY to get out but it will be difficult. Needless to say these are NOT the sort of neighbours who are open to reason...
If any body hits a parked car it is their fault! I also think you will find that if the disabled bay is on a public road for the use of the person living in a nearby house, anybody can legally park in it.
I'll ask again.....
If a disabled driver parked there, would this also block your husband in?

NO if neighbour had've parked better he would not be parked in (in other words she has plenty of spae to pull forward but has intentionally parked as close to my hubs as poss? VODKAANDCOKE I don't want to call the police to move it they have better things to do with their time.
It's what Comunity Policemen are for, evedawn - you could at least ring your local cop shop and ask for advice over the phone?
Yes as RATTER says anyone can park on some of these bays whether they hold a blue badge or not. It depends on the type of bay and the signs or marking that go with it. Some can be enforcedand others can't. Not sure on which is which though.
just knock and ask them to move so your husband can get out

ojread2 - Yes that's what we would do with a ORMAL person. This neighbour is very aggressive and there have been problems for many years with him. We try avoid him wherepossible.
Well I have had to call them myself for that same thing and they were extremely helpful. They dealt with the guy who was illegally parked.
