i am sure 99% i was not speeding, i got a notice to prosecute, how can i fight this ?

So why would the NIP be sent to an address in Liverpool if you maintain the DVLA have never had the RK (you) at an address in Liverpool.

Somehow DVLA latched onto an address you claim you lived at in Liverpool for only four days, and never had the vehicle registered there anyway.

i am now in liverpool , i work in liverpool, my adress is in belfast allwatys has been, my address in belfast is registered with dva and electoral reg. so how to hell did cops get an address where i only used for 4 days ?
was speaking to guys in work yesterday, one told me to fight it and ask for calibration and photos etc, another guy from wales has had 3 notices to prosecute and has binned them and not heard a word back !! nice one if u can get away with it.

I don't see how the NIP can arrive at the address of your digs in Liverpool if the car is registered in Belfast. The authorities don't look up the address at DVLA and then say, yeah but we know he's at Jim's B&B round the corner lets send it there! This whole scenario over both posts does not add up, i'd like to see all the paper work! I smell a rat!
What address is on the registration document ?
If it's the liverpool address - then why didn't you correct it with the DVLA when they sent it to you ?
If it's the Belfast adress , then i can't see why it was despatched to the liverpool address . As has been stated DVLA haven't got a bloke sitting there looking up adresses to Despatch NIP'S - the adress would have automatically lifted by the computer from what they have, registered .
If some error has been made somehow by the DVLA computer - then what would be the chances of it been sent to an address , which just happens to be somewhere where you have stayed in the past / is currently staying ?

Your Liverpool address hasn't somehow been used by you for insurance purposes,as we all know that the premium to insure a car is at least double if you live in Belfast compared to Liverpool.?
I hope this is not the case here, as doing this would invalidate your insurance.

I think 40 in a 30 limit is within the range for a speed awareness course rather than points and a fine

If you plead guilty and ask for the course you may very well get away without a fine or points. I would also add that the chance of disproving the speeding is virtually zero! I know a police traffic officer and he says that he has never known anyone prove that the speed camera is wrong.

The reason that I am asking is that the police are well aware of the higher premiums required in Belfast,and the prevalence of drivers falsifying their address with their Insurance Company,resulting in the insurance being invalidated.
This makes matters much more serious and enables a charge of driving without insurance to be proceeded with. Very high fine and large number of points,to say nothing of possible disqualification.
I would cut my losses if I were you.
