For more on marking an answer as the "Best Answer", please visit our FAQ.IMO if the child ran out in frint of the car, then their parents are responsible; but if a car malfunction caused the tragedy then either the design/manufacturer company of the car is responsible, or if they have performed due dilligence then either the last service establishment or it is an unavoidable tragedy and no one takes blame.
TTT – it’s a question of whether you want one child a day killed by a drunk driver, or probably less than one child a year killed by an errant driverless car; I know which I’d prefer.
In the not too distant future, people will not bother to learn to drive – why go to all that trouble and expense to learn, just to do something a machine can do far, far better than you (on your best day)?

"Is it not simple? Just make the person still in charge of the vehicle. No drugs, no alcohol. Common sense? " yes but no point in having a drverless car then. I would rather drive it myself if I'm going to be held resposible for what it does anyway. Eddie: how do they resolve accidents in Utah then? It may be technicaly legal but just wait until someone crashes. Perhaps hymie but statistics are no defence in court. OG, the problem is that all those things are a matter of opinion and impossible to prove, what if a tyre bursts who are you going to pin that on? the tyre manufacturer? the firm that made the nail that went through it? The truck that dropped the nail? The man that mined the ore to make the nail. Stand on me the legal obstacles are insurmountable.
In the fullness of time, humans will not be permitted by law to control powered vehicles on our roads – our law makers will realise that under human control just too many accidents occur.
Before that happens, there will be a time when both autonomous and human controlled vehicles coexist on our roads. But this period will be short, in that no one will want to learn to drive, and those who want to control their vehicle will pay a heavy insurance premium – due to the increased risk involved.
I’m sure most would be happy to have their insurance premium slashed by a factor of 10, or more – which went to payout the small number of no fault claims.
Before that happens, there will be a time when both autonomous and human controlled vehicles coexist on our roads. One thing for sure that will be fitted to autonomous vehicles is 360 degree continuous image recording.
Imagine for your drive to work next week, you have a choice of your current car – or an autonomous vehicle, which statistically is >90% less likely to be involved in an accident compared with you driving your car – and you can relax doing whatever you please during the journey.
