Yes it is.  But if that is all that is wrong it is likely that the driver would get no more than a requirement to get it fixed.
Its an offence if its one of the two main brake lights that's not working.  The 3rd/high level brake light doesn't matter.
Would make for some pretty hairy tailgating moments too.
All brake lights fitted must be working. Minimum of two on a car, but if additional ones are fitted they must work.
Vehicles first used on or after 1st January 1971 must be fitted with at least two obligatory stop lamps.

Vehicles first used before 1st January 1971 must be fitted with one stop lamp either on or to the offside of the vehicle centre line. If more than one stop lamp is fitted they must all work.

Vehicles first used before 1st January 1936 are not required to be fitted with a stop lamp.

Get it fixed , it's probably only a bulb gone, or a bad earth, if the power to it is gone an easy quick fix is to hook up to the other side that works.
