we bought a car 3 feb and the seller said he would send log book off, but wse have heard nothing but we have checked tax and it taxed till dec 17

If it appears to be taxed until the end of December it must have been taxed during January. i.e. before you bought it. So that tax was automatically cancelled when the vehicle changed hands. You were then obliged to tax the vehicle yourself, using the 'new keeper's details' slip from the V5C, as soon as you bought it.

So have you actually taxed it?
You cannot now buy a vehicle with tax already on. It is cancelled when sold to you. You should have been given a change of owner slip from the V5 to get the tax for you to be legally on the road.
yes i know that but when we check tax comes up TAXED if they last person paiid by cash for tax then how can they refund
perhaps whoever you bought it off hasn't sent in their paperwork yet?

It seems like the previous owner of the car has forgotten to send off the paperwork to the DVLA.

As long as you've got the green 'new keeper's details' slip you can apply directly for a new log book, without having to pay the £25 fee which would normally apply. You simply need to fill in this form and post it (enclosing the 'new keeper's details' slip):
